The meeting convened at 6:00 p.m.
6:04 pm – 6:22 pm Public Hearing, Nault, WPA ANOI – 45 Northeast Cove Rd. Approved and conditioned.
The chair read the public notice and reopened this continued hearing. The applicant presented the abutter notification and return receipts. The DEP file number had been received. The applicant showed where 1 – 3 trees may come down for the project. The commission wished an added silt fence to protect the Lake from the excavated material stockpile. The hearing was closed after no public comment was offered. We voted to approve and condition the application. Final drawings are in the files [S-0.b 7 June 05, A-4 5 May 05, and White Engineering site plan section dated 1998] Conditions on separate sheet.
6:35 pm – 6:55pm Public Hearing, Shifrin, WPA NOI – 52 Sylvan Rd Amended OOC
Shannon Boomsma, White Engineering appeared with request to amend the existing Order of Conditions. The project changed slightly, while under construction, and the applicant wanted to include i) a retaining wall, ii) walk-out basement, iii) tree cutting (2-12” or greater and 4-6” to 12” trees) and installation and removal of a temporary construction road to access the rear of the project, and iv) add a yard drain in front of the walk out. The original plan is to demolish existing house leaving the stone chimney and erecting a new house. The well has been drilled, the house demolished. The commission felt the project changes could be managed in an Amended OOC. The vote was unanimous. Conditions on separate sheet.
7:00 pm Public Meeting, Blaskey, WPA RDA – 578 Main Rd. Continued
Mike Parsons representing Blaskey. Their project is on a +-45,000SF lot. Their temporary disturbance is +-8???? SF and the permanent disturbance is +-2??? SF. The project is a 2 story addition to an existing residence within the 100 ft Buffer Zone of an intermittent stream and Bank. The addition will prevent driveway runoff from directly entering the stream as is possible now. There is no way to push the project out of the 1st 50 feet of the Buffer Zone. The public meeting was continued until the 14 November 2005 meeting at which time we hope to obtain confirmation from the applicant of Board of Health permitting of the project.
7:20 pm Enforcement Order, Lombardo Group – Mt Hunger Rd Map 9 Lot 52 (portion of) Stream Destruction
Mike Parsons provided information from Webster-Ingersoll that the required work is complete as specified. At such time the Commission wants to make a site visit either representative will be available on site if requested.
7:25 pm Public Meeting, Nowak, WPA RDA, 70 Harmon Rd. N-2
Chuck Nelson, CN Landscape Design appeared, with the owner Mr Nowak, to present plans for modifications to (3) existing, somewhat isolated ponds on their property. The basins are in a large mowed area described as lawn and are not now interconnected other than by storm overflow. The project involves connecting the three with 2 rubber lined channels, installing a recirculating pump, raising the grassy bank on the lowest pond and planting new plants in and around the work area.
General:
1. Ask someone from Parks Department to represent their application. No one available to ask questions.
2. Tim Lovitt recused himself from the meeting.
8:00 pm Public Meeting, Lovett, WPA RDA, L Garfield 28 Eaton Rd. N-5
Tim Lovitt representing himself provided the Waterways Dock License and an RDA for the reconstruction of a dock attached to the existing lakeside boathouse. The proposed dock was 225 SF of area of an allowable 300 SF. Lovitt proposed a 2-year construction period to be done during the draw downs of L Garfield. The project was approved as a N-5 for a limited project under 10.53 (3) (j) relating to dock construction. A copy of the DA should be sent to the state BRP WW division.
8:20 pm Certificate of Compliance, LeProvost/Nolan
Horizon Consulting Engineers request a Certificate of Compliance for the restoration work done after the Nolan truck accident into the Konkapot tributary. Work had been complete as described. The work area is stable and will be revegetated well in the coming seasons.
8:25 pm Public Hearing, Town of Monterey, WPA NOI, L Garfield
The Town requested an extension of the existing OOC for the draw down of L Garfield. A letter was provided. The new OOC was extended to 15 October 2008. The commission debated extending it to a shorter period but decided the regularity and care taken in the process warranted the full extension. The Commission will send a letter to DPW director Maynard Forbes and the Selectboard of the Town saying i) we will not extend this OOC for another period after its expiration, ii) the Town must raise funds for a consultant to file a new Notice of Intent for the Draw down of L Garfield, iii) the new NOI shall be in conformance with the new and flexible guidelines issued by the state in the form of “Final Generic Environmental Impact Report: Eutrophication and Aquatic Plant Management in
Massachusetts”, and the Town shall file the NOI for L Drawdown no later than 1 February 2008.
General business:
1. Reviewed and approved prior meeting minutes
2. Next meeting is on 14 November 2005, on our regular schedule.
3. Christopher Blair is the Preliminary Building Permit reviewer for October 2005.
4. Reviewed status of open projects. Those on the list are all current. There was no project on the list from much before the last two or three months. Maltausch is one example; it is ongoing, not complete, and has had complaints. We need a more extended list to get a current list of open projects.
5. Discussion of attending MACC Conservation Commissioner courses on 5 November. B Gauthier is out for a few days. Chairman will submit request for payment.
